Resumo Omnilex

The Federal Constitutional Court did not admit the constitutional complaint. It held that the complainant had not complied with subsidiarity because he failed to show that he had pursued, or why he could not reasonably pursue, a subsequent application for reimbursement under § 12(2) BhV as indicated by the Federal Administrative Court. The complaint was also insufficiently substantiated because it offered only a general assertion that the exclusion of non-prescription medicines from aid coverage was unconstitutional.

Sumário Omnilex

Art. 33 Abs. 5 GG, § 90 Abs. 2 sentence 1 BVerfGG; subsidiarity and substantiation of the constitutional complaint: A constitutional complaint is inadmissible if the complainant fails to use a reasonable procedural avenue still available for obtaining relief before the specialist courts, including a subsequent application expressly suggested by the previous instance. The subsidiarity principle obliges the complainant to exhaust all procedurally and factually reasonable possibilities of legal protection. In addition, the complaint must be substantiated under §§ 23(1) sentence 2, 92 BVerfGG; a merely abstract assertion of unconstitutionality, without addressing the alternative legal route and its alleged ineffectiveness, is insufficient (consid. 1-2).

Titelzeile

Whether the constitutional complaint was admissible despite the possibility of a subsequent application under § 12(2) BhV.

Decisão extraída

The complaint was inadmissible because the complainant did not exhaust all reasonable avenues of relief; he did not show that he had pursued, or why he considered futile, a subsequent application under § 12(2) BhV.

Fundamentação extraída

Subsidiarity requires use of all reasonable procedural means available to obtain relief before the ordinary courts. The complainant failed to address the avenue indicated by the Federal Administrative Court.

Questão jurídica principal

Whether the complaint met the requirements of substantiation under the Federal Constitutional Court Act.

Decisão extraída

No. The submission remained a bare assertion that the exclusion of non-prescription medicines from reimbursement was unconstitutional.

Fundamentação extraída

Because the complainant neither described the relevant procedural route nor explained why it would not be useful, the complaint did not satisfy the substantiation requirements of § 23(1) sentence 2 and § 92 BVerfGG.
