The Federal Constitutional Court did not admit the constitutional complaint against a Baden-Württemberg social court ruling on SGB II benefits. It held that counting payments from a private health insurer as income and spreading them over twelve months was constitutionally unobjectionable. The constitutional guarantee of a dignified minimum existence is engaged only where no usable means remain. If funds exist but cannot be used for living expenses because of their disposition, recourse to loan-based assistance may be constitutionally permissible. However, a constitutional complaint is inadmissible under subsidiarity insofar as the alleged entitlement to loan-based assistance was not first pursued before the specialist courts; the Federal Constitutional Court is not a first-instance forum for such claims (consid. 3). A legal-aid request in constitutional proceedings requires a sufficiently substantiated prospect of success (consid. 4).

Gründe

1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen, weil die Annahmevoraussetzungen des § 93a Abs. 2 BVerfGG nicht vorliegen. Sie hat keine hinreichende Aussicht auf Erfolg. Damit erledigt sich der Antrag auf Erlass einer einstweiligen Anordnung. Der Antrag auf Gewährung von Prozesskostenhilfe und Beiordnung des Verfahrensbevollmächtigten ist mangels Erfolgsaussichten abzulehnen.

2 Soweit sich die Verfassungsbeschwerde gegen die Entscheidung des Landessozialgerichts in der Sache richtet und soweit mit ihr die Gewährung von Leistungen als Zuschuss begehrt wird, ist die Verfassungsbeschwerde jedenfalls unbegründet. Die Anrechnung der Zahlung des privaten Krankenversicherers als Einkommen im Sinne von § 11 Abs. 1 Satz 1 Sozialgesetzbuch Zweites Buch (SGB II) und die Aufteilung auf zwölf Monate ist verfassungsrechtlich nicht zu beanstanden. Das Grundrecht auf Gewährleistung eines menschenwürdigen Existenzminimums (Art. 1 Abs. 1 i.V.m. Art. 20 Abs. 3 GG) wird erst aktiviert, wenn andere Mittel zur Sicherung eines menschenwürdigen Daseins nicht vorhanden sind (vgl. BVerfG, Urteil des Ersten Senats vom 9. Februar 2010 - 1 BvL 1/09 u.a. -, NJW 2010, S. 505 <507, Rn. 134>). Sollten solche eigentlich vorhandenen Mittel - zum Beispiel aufgrund anderer Verwendung - nicht mehr zur Sicherung des Lebensunterhaltes eingesetzt werden können, ist es verfassungsrechtlich nicht zu beanstanden, den Hilfebedürftigen auf eine darlehensweise Leistungsgewährung nach § 23 Abs. 1 SGB II zu verweisen (vgl. BVerfG, Urteil des Ersten Senats vom 9. Februar 2010 - 1 BvL 1/09 u.a. -, NJW 2010, S. 505 <509, Rn. 150>).

3 Soweit mit der Verfassungsbeschwerde hilfsweise die Gewährung von Leistungen als Darlehen begehrt wird, steht ihrer Zulässigkeit der in § 90 Abs. 2 Satz 1 BVerfGG zum Ausdruck kommende Grundsatz der Subsidiarität entgegen. Das Landessozialgericht hat ausweislich der Gründe seines Beschlusses nur darüber entschieden, ob der Beschwerdeführer einen Anspruch auf höhere Leistungen in Form eines Zuschusses hat. Das Landessozialgericht hat indes nicht über eine darlehensweise Leistungsgewährung nach § 23 Abs. 1 SGB II - sei es als Geldleistung, sei es als Sachleistung (vgl. zur Zulässigkeit der Erbringung von Sachleistungen BVerfG, Urteil des Ersten Senats vom 9. Februar 2010 - 1 BvL 1/09 u.a. -, NJW 2010, S. 505 <508, Rn. 138>) - entschieden, obwohl dies bei sachgerechter Auslegung des Begehrens des Beschwerdeführers nahegelegen hätte. Vor Inanspruchnahme des Bundesverfassungsgerichtes hat der Beschwerdeführer die Frage, ob ein solcher darlehensweiser Anspruch besteht, zunächst einer Klärung durch die Fachgerichte zuzuführen.

4 Soweit sich die Verfassungsbeschwerde gegen die Ablehnung der Prozesskostenhilfe für das fachgerichtliche Verfahren richtet, ist sie nicht hinreichend begründet (§ 23 Abs. 1 Satz 2, § 92 BVerfGG). Die Möglichkeit einer Grundrechtsverletzung ist nicht substantiiert dargetan.

5 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

6 Diese Entscheidung ist unanfechtbar.
