The Federal Court dismissed the defendants’ revisions against the LG Hechingen judgment as unfounded and ordered each appellant to bear the costs of his own appeal. In an additional remark, it held that the 2016 amendment of the human-trafficking provisions did not affect the conviction of K., because the old and new provisions maintained continuity of the offense conduct within the meaning of Art. 2(3) StGB; the trial court had therefore correctly relied on the law in force at completion of the offence.

Art. 2 Abs. 3 StGB; §§ 232, 232a StGB as amended: Where a statutory amendment replaces the applicable offense provisions but preserves the material content of the offense, the principle of the milder law does not require application of the new law if there is no relevant discontinuity of wrongdoing. For completed conduct, the law in force at the time of completion remains decisive unless the new provisions alter the substantive assessment of the act in a way that is favorable to the accused. A mere renumbering or restructuring of the offense catalogue, without material change in elements or protected legal interest, does not interrupt Unrechtskontinuität (consid. addendum).

Anwendung des nach Gesetzesänderung mildesten Gesetzes im Strafverfahren: Unrechtskontinuität bei Neuregelung der Vorschriften zum Menschenhandel zum Zweck der sexuellen Ausbeutung

Tenor

Die Revisionen der Angeklagten gegen das Urteil des Landgerichts Hechingen vom 8. Juli 2016 werden als unbegründet verworfen (§ 349 Abs. 2 StPO).

Jeder Beschwerdeführer hat die Kosten seines Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat zum Antrag des Generalbundesanwalts in Bezug auf die Revision des Angeklagten K. :

Durch das Gesetz zur Verbesserung der Bekämpfung des Menschenhandels und zur Änderung des Bundeszentralregistergesetzes sowie des Achten Buches des Sozialgesetzbuchs vom 11. Oktober 2016 (BGBl. I 2016, 2226) erfolgte eine Novellierung der §§ 232 bis 233b StGB, die zum 15. Oktober 2016 in Kraft getreten ist. Soweit das Landgericht im Schuldspruch beim Angeklagten K. die bei Beendigung der Tat (§ 2 Abs. 1 StGB) geltenden bisherigen Fassungen des § 232 Abs. 1 Satz 1 1. Alternative und § 232 Abs. 4 Nr. 1 StGB berücksichtigt, ist die erforderliche Unrechtskontinuität im Sinne des § 2 Abs. 3 StGB gewahrt. An die Stelle der genannten zum Tatzeitpunkt geltenden Strafnormen zum Menschenhandel zum Zweck der sexuellen Ausbeutung sind durch das genannte Änderungsgesetz die Regelungen des § 232a Abs. 1 Nr. 1 StGB und § 232a Abs. 3 StGB zur Zwangsprostitution getreten, ohne dass es durch die Neuregelung zu hier relevanten Änderungen im Regelungsgehalt der Straftatbestände gekommen ist (vgl. auch BT-Drucks. 18/9095, S. 32 ff.).
