The Bundesgerichtshof dismissed the revision of the unnamed secondary participant against the Stuttgart Regional Court judgment. Die Eröffnung des Insolvenzverfahrens berührt die Zulässigkeit dieser Feststellung nicht; sie hindert weder deren Erlass noch deren Bestand. Die Revision, die sich hiergegen richtet, bleibt unbegründet, wenn sonstige revisible Rechtsfehler nicht ersichtlich sind (vgl. auch die Bezugnahme auf die ständige Rechtsprechung in den Gründen).

Ergänzend bemerkt der Senat:
Der Umstand, dass über das Vermögen der Nebenbeteiligten das Insolvenzverfahren eröffnet ist, steht einer Feststellung nach § 111i Abs. 2 StPO nicht entgegen (vgl. BGH, Urteil vom 4. Dezember 2014 - 4 StR 60/14, BGHSt 60, 75; Beschluss vom 12. März 2015 - 2 StR 322/14, NStZ-RR 2015, 171).
