The Federal Court of Justice rejected the defendant’s revision against the Chemnitz Regional Court judgment. The only relevant complaint concerned an alleged breach of the court’s duty to disclose plea-related discussions under § 243(4) sentence 1 StPO. The Senate held that the discussions had taken place in a public main hearing before the case was referred under § 270(1) StPO, in the presence of the defendant and his counsel, and therefore were not covered by the statutory notification duty. No analogous application of § 243(4) StPO was justified. The revision was therefore unfounded and the defendant had to bear the costs.

Werden entsprechende Erörterungen in öffentlicher Hauptverhandlung in Anwesenheit des Angeklagten und seines Verteidigers geführt, besteht keine Mitteilungspflicht; eine analoge Anwendung des § 243 Abs. 4 S. 1 StPO scheidet aus, weil es an einer planwidrigen Regelungslücke und an der vergleichbaren Interessenlage fehlt (vgl. Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Chemnitz vom 28. September 2016 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat.

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Die Rüge einer Verletzung von § 243 Abs. 4 Satz 1 StPO dringt schon deshalb nicht durch, weil es sich bei den Gesprächen vor dem Schöffengericht vor der Verweisung nach § 270 Abs. 1 StPO nicht um solche im Sinne von §§ 202a, 212 StPO gehandelt hat, sondern diese in einer öffentlichen Hauptverhandlung in Anwesenheit des Angeklagten und seines Verteidigers geführt wurden. Für solche Konstellationen sieht der Senat auch keinen Anlass für eine analoge Anwendung von § 243 Abs. 4 Satz 1 StPO.
