The debtor requested supplementation of the BGH order of 2011-07-05 after his legal aid request had been refused. The Senate held that it had already fully examined the prospects of success of the intended proceedings and that no further remedy, in particular no so-called 'exceptional appeal', existed. The application for supplementation was therefore rejected, and the debtor was told not to expect responses to further submissions in the matter.

Tenor

Der Antrag des Schuldners auf Ergänzung des Beschlusses vom 5. Juli 2011 wird abgelehnt.

Gründe

1 Der Senat hat die Erfolgsaussichten der vom Schuldner beabsichtigten Rechtsverfolgung bei Abfassung des Beschlusses vom 5. Juli 2011 in vollem Umfang überprüft und die beantragte Prozesskostenhilfe in demselben Umfang abgelehnt. Andere als die in den Beschlussgründen genannten Rechtsmittel kommen von vornherein nicht in Betracht. Das Rechtsmittel einer "Ausnahmebeschwerde" gibt es nicht (BGH, Beschluss vom 7. März 2002 - IX ZB 11/02, BGHZ 150, 133 ff); seine Anerkennung ist verfassungsrechtlich auch nicht geboten (vgl. BVerfGE 107, 395 ff).

2 Der Schuldner kann nicht damit rechnen, in dieser Sache Antwort auf weitere Eingaben zu erhalten.
