Leitsatz

Das im maßgeblichen Zeitpunkt vorhandene Wissen der Finanzbehörde wird einer anderen Behörde desselben Rechtsträgers auch dann zugerechnet, wenn diese die Informationen erst im Laufe des Rechtsstreits zum Zwecke der Aufrechnung einholt.

Tenor

Die Beschwerde gegen die Nichtzulassung der Revision in dem Urteil des 3. Zivilsenats des Oberlandesgerichts Frankfurt am Main vom 17. Juli 2012 wird auf Kosten des Beklagten zurückgewiesen.

Der Wert des Verfahrens der Nichtzulassungsbeschwerde wird auf 142.551,73 € festgesetzt.

Gründe

1 Die Nichtzulassungsbeschwerde ist statthaft (§ 544 Abs. 1 Satz 1 ZPO) und zulässig (§ 544 Abs. 1 Satz 2, Abs. 2 ZPO). Sie hat jedoch keinen Erfolg. Die Rechtssache hat weder grundsätzliche Bedeutung, noch erfordert die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts (§ 543 Abs. 2 Satz 1 ZPO). Die geltend gemachte Verletzung von Verfahrensgrundrechten hat der Senat geprüft, aber für nicht durchgreifend erachtet.

2 Insbesondere weicht das Berufungsurteil nicht von dem Urteil des Bundesgerichtshofs vom 30. Juni 2011 (IX ZR 155/08, BGHZ 190, 201) ab. Die dort angenommene aufgabenbezogene Handlungs- und Informationseinheit entsteht ab dem Zeitpunkt, ab dem eine Behörde von der Möglichkeit der Wissensbeschaffung bei anderen Behörden desselben Rechtsträgers Gebrauch macht. In diesem Fall hat sie sich das gesamte rechtserhebliche Wissen der einbezogenen Behörden hinsichtlich des abgewickelten Vorgangs zurechnen zu lassen, mithin auch das Wissen um den Gläubigerbenachteiligungsvorsatz des Schuldners zum Zeitpunkt des § 140 InsO. Ab dem Zeitpunkt der Wissensbeschaffung ist auf das zuzurechnende Gesamtwissen der beteiligten Behörden abzustellen (BGH, aaO Rn. 22 f). Es genügt für die Wissenszurechnung, dass die Möglichkeit bestand, die Informationen im maßgeblichen Zeitpunkt innerhalb der Organisation zusammenzuführen. Die Wissenszurechnung findet deshalb auch statt, wenn die zuständige Behörde erst zu einem späteren Zeitpunkt - vorliegend erst im Prozess über die eingeklagte Bauforderung - prüft, ob sie mit rückständigen Steuerforderungen aufrechnen kann.

3 Von einer weiteren Begründung wird gemäß § 544 Abs. 4 Satz 2 Halbs. 2 ZPO abgesehen, weil sie nicht geeignet wäre, zur Klärung der Voraussetzungen beizutragen, unter denen eine Revision zuzulassen ist.
