The Federal Labour Court decided by acknowledgment judgment in a revision proceeding arising from an employment dispute. It set aside the judgment of the Landesarbeitsgericht Berlin-Brandenburg and rejected the defendant's appeal against the partial judgment of the Arbeitsgericht Berlin.   1. Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Berlin-Brandenburg vom 15. Juli 2016 - 3 Sa 158/16 - aufgehoben.

  2. Die Berufung der Beklagten gegen das Teilurteil des Arbeitsgerichts Berlin vom 29. Juli 2015 - 14 Ca 2611/15 - wird zurückgewiesen.

  3. Die Beklagte hat die Kosten der Berufung und der Revision zu tragen.

Sonstige Leitsätze
