The Federal Labor Court, 3rd Senate, decided an employment appeal on the basis of the parties' waiver of facts and reasons under § 313a ZPO. It set aside the Cologne Higher Labor Court judgment insofar as it had upheld the claimant's appeal against the Cologne Labor Court decision, and it dismissed the claimant's appeal in full. The claimant was ordered to bear the costs of the appeal and revision proceedings.

Auf die Revision der Beklagten zu 1. wird - unter Zurückweisung der Revision des Klägers - das Urteil des Landesarbeitsgerichts Köln vom 15. Januar 2015 - 8 Sa 32/15 - aufgehoben, soweit es der Berufung des Klägers gegen das Urteil des Arbeitsgerichts Köln vom 12. Februar 2014 - 3 Ca 1551/13 - stattgegeben hat.
Die Berufung des Klägers wird insgesamt zurückgewiesen.
Der Kläger hat die Kosten der Berufung und des Revisionsverfahrens zu tragen.
