In this labour-law revision, the Federal Labour Court partly upheld the defendant's appeal. It set aside the Cologne Regional Labour Court judgment in part and amended the Cologne Labour Court judgment to dismiss the claimant's request for an accounting statement. In the remaining part, the revision was rejected. Because the defendant succeeded only partially, the court allocated costs 19% to the claimant and 81% to the defendant. The decision was issued without a statement of facts or reasons under § 313a ZPO.
§ 313a ZPO; where the parties waive findings of fact and reasons, the judgment may be rendered without a full written statement. On revision, partial success leads to partial setting aside of the appellate judgment and corresponding amendment of the first-instance judgment only to the extent necessary for the dispositive part; the remainder stands. Costs are to be apportioned according to the parties' respective success and failure.

Auf die Revision der Beklagten wird das Urteil des Landesarbeitsgerichts Köln vom 12. März 2015 - 7 Sa 736/14 - teilweise aufgehoben.
Auf die Berufung der Beklagten wird das Urteil des Arbeitsgerichts Köln vom 18. Juli 2014 - 19 Ca 8882/13 - teilweise abgeändert und der Klageantrag auf Erteilung einer Abrechnung abgewiesen.
Im Übrigen wird die Revision der Beklagten zurückgewiesen.
Der Kläger hat die Kosten des Rechtsstreits zu 19 % und die Beklagte zu 81 % zu tragen.
