In revision proceedings before the Federal Labour Court, the plaintiff succeeded in overturning the appellate judgment of the Lower Saxony Regional Labour Court and obtaining a modified judgment against the defendant. The defendant was ordered to pay EUR 519.49 gross plus default interest from 5 August 2012. The defendant also had to bear the costs. Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Niedersachsen vom 5. August 2013 - 10 Sa 35/13 - aufgehoben.
Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Nienburg vom 22. November 2012 - 2 Ca 309/12 - abgeändert.
Die Beklagte wird verurteilt, an den Kläger 519,49 Euro brutto nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 5. August 2012 zu zahlen.
Die Beklagte hat die Kosten des Rechtsstreits zu tragen.
