The Federal Labour Court heard the claimant's revision in an employment dispute over EUR 457.85 gross. The parties had waived findings of fact and reasons. Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Niedersachsen vom 5. August 2013 - 10 Sa 38/13 - aufgehoben.
Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Nienburg vom 22. November 2012 - 2 Ca 307/12 - abgeändert.
Die Beklagte wird verurteilt, an den Kläger 457,85 Euro brutto nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 5. August 2012 zu zahlen.
Die Beklagte hat die Kosten des Rechtsstreits zu tragen.
