In a labour-law revision, the Federal Labour Court set aside the judgment of the Lower Saxony Regional Labour Court and amended the Nienburg Labour Court’s decision. The plaintiff’s appeal succeeded: the defendant was ordered to pay 243 euros gross plus interest at five percentage points above the base rate from 2012-08-05. The defendant was also ordered to bear the costs of the proceedings. The decision was issued without findings of fact or reasons because the parties waived them.

Tenor

Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Niedersachsen vom 5. August 2013 - 10 Sa 44/13 - aufgehoben.

Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Nienburg vom 22. November 2012 - 2 Ca 312/12 - abgeändert.

Die Beklagte wird verurteilt, an den Kläger 243,00 Euro brutto nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 5. August 2012 zu zahlen.

Die Beklagte hat die Kosten des Rechtsstreits zu tragen.

Sonstige Leitsätze

1 Die Parteien haben auf Tatbestand und Entscheidungsgründe verzichtet (§ 313a Abs. 1 ZPO) .
