The Federal Labor Court dismissed the claimant's revision against the judgment of the Hessian Regional Labor Court. The parties had waived findings of fact and reasons because of a parallel case. The claimant was ordered to bear the costs of the revision.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1 ZPO; § 313a Abs. 1 Satz 2 ZPO: Where the parties waive findings of fact and reasons in view of a parallel proceeding, the Federal Labor Court may decide the revision without a full statement of grounds. If the revision is unfounded, it is dismissed and the costs of the revision are borne by the appellant.
