Resumo

The employee appealed to the Federal Labor Court against a judgment of the Hessian Regional Labor Court. The court set aside the appellate judgment and amended the first-instance judgment, declaring that the employment relationship was not terminated by the employer's notice of dismissal dated 2009-12-24. Costs were allocated mostly to the defendant, with an exception for the costs caused by the claimant's default at the hearing of 2011-06-20.

§ 313a ZPO; waiver of statement of facts and reasons: Where the parties waive the statement of facts and the reasons for the judgment, the court may decide in abbreviated form. In a dismissal dispute, the Federal Labor Court may, on revision, set aside the appellate judgment and grant declaratory relief if the employment relationship was not terminated by the contested notice of dismissal; cost allocation may distinguish between the general costs of the dispute and costs caused by a party's default at a hearing (consid. tenor).

Tenor

  1. Auf die Revision des Klägers wird das Urteil des Hessischen Landesarbeitsgerichts vom 31. Oktober 2011 - 17 Sa 1667/10 - aufgehoben.

  2. Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Frankfurt am Main vom 8. September 2010 - 2 Ca 342/10 - abgeändert:

Es wird festgestellt, dass das zwischen den Parteien bestehende Arbeitsverhältnis durch die Kündigung vom 24. Dezember 2009 nicht aufgelöst worden ist.

  1. Die Beklagte hat die Kosten des Rechtsstreits zu tragen mit Ausnahme der durch die Säumnis des Klägers im Termin vom 20. Juni 2011 veranlassten Kosten, welche der Kläger zu tragen hat.
