Auf die Revision des Beklagten wird das Urteil des Landesarbeitsgerichts Mecklenburg-Vorpommern vom 4. Januar 2011 - 5 Sa 138/10 - aufgehoben.
Auf die Berufung des Beklagten wird das Urteil des Arbeitsgerichts Schwerin vom 17. Dezember 2009 - 6 Ca 1285/09 - abgeändert und die Klage abgewiesen.
Der Kläger hat die Kosten des Rechtsstreits zu tragen.
