The Federal Labor Court dismissed the claimant's revision against the judgment of the Hessian Regional Labor Court. In connection with the lead case 9 AZR 504/10, the parties waived the statement of facts and reasons. The only operative parts of the judgment are the dismissal of the revision and the allocation of the revision costs to the claimant.
§ 72 Abs. 5 ArbGG i.V.m. § 555 Abs. 1 Satz 1, § 313a Abs. 1 ZPO; where the parties waive findings of fact and reasons, the appellate court may issue a reasonless judgment limited to the dispositive part. If the revision is unsuccessful, the revising party bears the costs of the revision proceedings.
