In this labour case, the Federal Labour Court decided by recognition judgment. Because the defendant acknowledged the claim, the court dispensed with a statement of facts and reasons under § 313b(1) sentence 1 ZPO. The court set aside the Munich Higher Labour Court judgment, amended the Augsburg Labour Court judgment, and ordered the defendant to pay the plaintiff EUR 9,203.00 gross plus interest at five percentage points above the base rate since 1 December 2008. The defendant was ordered to bear the costs.
§ 313b Abs. 1 Satz 1 ZPO; recognition judgment without statement of facts and reasons: If the defendant acknowledges the claim, the court may issue a recognition judgment without a factual statement and reasons. The acknowledgment also justifies granting the acknowledged claim by judgment under § 307 ZPO. In such a case, the appellate judgments below are to be set aside or amended in accordance with the acknowledgment; costs follow the result of the acknowledgment and are borne by the defendant.

Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts München vom 30. März 2010 - 6 Sa 1199/09 - aufgehoben. Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Augsburg vom 18. November 2009 - 10 Ca 4151/08 - abgeändert und die Beklagte verurteilt, an den Kläger einen Bruttobetrag iHv. 9.203,00 Euro nebst Zinsen iHv. fünf Prozentpunkten über dem Basiszinssatz seit dem 1. Dezember 2008 zu zahlen.
Die Beklagte trägt die Kosten des Rechtsstreits.
