The Federal Labour Court decided by recognition judgment that the defendant had acknowledged the employee’s claim. It set aside the judgment of the Thuringian Regional Labour Court and amended the judgment of the Labour Court Eisenach. The court declared that the fixed-term employment relationship dated 2008-06-30 did not end on that date, but continued as an indefinite employment relationship. The defendant was ordered to bear the costs.
§ 313b Abs. 1 Satz 1 ZPO; recognition judgment without statement of facts or reasons: if the defendant acknowledges the claim, the appellate court may decide without setting out the facts and reasons. The acknowledged declaratory claim is to be granted in accordance with the admission; the appellate judgment is to be set aside and the first-instance decision amended accordingly. Costs follow the outcome of the recognition judgment.

Auf die Revision der Klägerin wird das Urteil des Thüringer Landesarbeitsgerichts vom 17. November 2009 - 8 Sa 10/09 - aufgehoben.
Auf die Berufung der Klägerin wird das Urteil des Arbeitsgerichts Eisenach vom 12. November 2008 - 1 Ca 555/08 - abgeändert:
Es wird festgestellt, dass das Arbeitsverhältnis durch die Befristung vom 30. Juni 2008 nicht beendet worden ist, sondern als unbefristetes Arbeitsverhältnis über den 30. Juni 2008 fortbesteht.
Die Beklagte hat die Kosten des Rechtsstreits zu tragen.
