Auf die Berufung der Beklagten wird das Urteil des Arbeitsgerichts Frankfurt am Main vom 3. März 2009 - 12/24 Ca 5981/08 - abgeändert und die Klage abgewiesen.
Die Klägerin hat die Kosten des Rechtsstreits zu 7/8, die Beklagte zu 1/8 zu tragen.
