In this employment case, the Federal Labour Court upheld the defendant’s revision. It set aside the Hessian Regional Labour Court’s judgment, amended the Labour Court Frankfurt am Main’s judgment, and dismissed the plaintiff’s action. Auf die Berufung der Beklagten wird das Urteil des Arbeitsgerichts Frankfurt am Main vom 3. März 2009 - 12 Ca 5347/08 - abgeändert und die Klage abgewiesen.
Die Klägerin hat die Kosten des Rechtsstreits zu 7/8, die Beklagte zu 1/8 zu tragen.
