Resumo

The Federal Labour Court decided by acknowledgment judgment. Because the defendant acknowledged the employee’s claim, the court set aside the Regional Labour Court’s judgment, amended the Labour Court’s judgment, and ordered the employer to pay EUR 274.20 gross as performance bonus under § 18 TVöD plus interest from 1 January 2008. The defendant also had to bear the costs. The decision contains no statement of facts or reasons.

§ 313b Abs. 1 Satz 1 ZPO; acknowledgment judgment without statement of facts or reasons. Where the defendant acknowledges the claim, the court may decide by acknowledgment judgment and dispense with the recitation of the facts and reasons. The acknowledgment leads to the granting of the claim in the acknowledged scope; prior judgments are to be set aside or amended accordingly. The dispositive allocation of costs follows the result of the acknowledged claim; no substantive examination of the merits is required (cf. § 18 TVöD as the claim basis).

Tenor

  1. Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Hamm vom 20. August 2009 - 17 Sa 701/09 - aufgehoben.

  2. Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Dortmund vom 22. Januar 2009 - 6 Ca 2696/08 - abgeändert.

Die Beklagte wird verurteilt, an den Kläger ein Leistungsentgelt iHv. 274,20 Euro brutto zu zahlen nebst Zinsen hierauf iHv. fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 1. Januar 2008.

  1. Die Beklagte hat die Kosten des Rechtsstreits zu tragen.

Sonstige Leitsätze

Von der Darstellung des Tatbestandes und der Entscheidungsgründe wird abgesehen (§ 313b Abs. 1 Satz 1 ZPO) . Die Beklagte hat den Klageanspruch anerkannt.
