The Federal Labour Court dismissed the claimant's revision against the judgment of the Baden-Württemberg Labour Court of Appeal. The court ordered the claimant to bear the costs of the revision. It stated that the facts and reasons were omitted under § 313a Abs. 1 ZPO.
§ 313a Abs. 1 ZPO; dismissal of revision without statement of facts and reasons: where the court disposes of the revision summarily, it may dispense with a recitation of the facts and reasons under the statutory conditions. If the revision is rejected, the unsuccessful appellant bears the costs of the revision proceedings.
