The Federal Labour Court dismissed the employer’s revision, while partly setting aside the Cologne Higher Labour Court judgment and partly amending the Cologne Labour Court judgment. It held that the employee is entitled to a monthly performance bonus totaling EUR 363.83 gross, less payments already made, for the period from 1 July 2007 to 31 August 2008. The bonus must also be included in the calculation of continued pay, additional vacation pay, and the thirteenth-month special payment under the applicable collective agreements. The employer must bear the costs of the revision.

The court may partly amend the operative part of the lower judgments and dismiss the revision insofar as the challenged decision is substantively correct (consid. operative part).

Die Beklagte ist verpflichtet, dem Kläger für die Zeit vom 1. Juli 2007 bis zum 31. August 2008 eine monatliche Leistungszulage in einer Gesamthöhe von 363,83 Euro brutto abzüglich bereits geleisteter Zahlungen zu zahlen und diese Leistungszulage bei der Berechnung des weiterzuzahlenden Monatsentgelts (§ 16 EMTV) , des zusätzlichen Urlaubsgelds (§ 14 Nr. 1 und Nr. 2 EMTV) sowie der Sonderzahlung (§ 2 Nr. 2.2 ETV 13. Monatseinkommen) zu berücksichtigen.
