The Federal Labour Court partly set aside the judgment of the Hessian Regional Labour Court in a BAT pay-grade dispute. It held the claimant's appeal inadmissible insofar as she sought a declaration that the defendant state had to pay basic salary according to pay group IIa, highest age step, for the period from 1 August 2008 to 31 December 2009. The court also ordered the claimant to bear the costs of the appeal and revision. The parties had waived findings of fact and reasons because of a parallel lead case.

§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO: In proceedings following a parallel lead case, the court may dispense with findings of fact and reasons. If the revision succeeds only in part and the challenged appellate relief is inadmissible, the Federal Labour Court sets aside the appellate judgment to that extent and dismisses the appeal as inadmissible; the unsuccessful party bears the costs of the appeal and revision.

Tenor

  1. Auf die Revision des beklagten Landes wird das Urteil des Hessischen Landesarbeitsgerichts vom 6. Januar 2010 - 2 Sa 1127/09 - teilweise aufgehoben.

  2. Die Berufung der Klägerin gegen das Urteil des Arbeitsgerichts Marburg vom 17. April 2009 - 2 Ca 167/09 - wird im Umfang der Feststellung, dass das beklagte Land verpflichtet ist, der Klägerin Grundvergütung nach der Vergütungsgruppe II a der Anlage 1a zum BAT nach der höchsten Lebensaltersstufe dieser Vergütungsgruppe für die Zeit vom 1. August 2008 bis zum 31. Dezember 2009 zu zahlen, als unzulässig verworfen.

  3. Die Klägerin hat die Kosten der Berufung und der Revision zu tragen.
