Resumo Omnilex

The claimant sought a declaration that the defendant state owed basic salary under BAT IV b at the highest age step for the period from 1 August 2008 to 31 December 2009. The Federal Labour Court partially set aside the Hessian LAG judgment and held the claimant's appeal inadmissible insofar as it concerned that declaration. The claimant was ordered to bear the costs of the appeal and revision. The decision was issued without a statement of facts or reasons because the parties waived them in view of the parallel lead case.

Sumário Omnilex

§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO: Waar; where the parties waive findings of fact and reasons in view of a parallel lead case, the appellate court may dispense with the statement of facts and reasons. If the appeal is inadmissible in the challenged scope, the Federal Labour Court dismisses it without examining the merits; the cost burden follows the outcome of the appeal and revision proceedings.
