Tenor

  1. Auf die Revision des beklagten Landes wird das Urteil des Hessischen Landesarbeitsgerichts vom 6. Januar 2010 - 2 Sa 1296/09 - teilweise aufgehoben.

  2. Die Berufung des Klägers gegen das Urteil des Arbeitsgerichts Gießen vom 16. April 2009 - 1 Ca 79/09 - wird im Umfang der Feststellung, dass das beklagte Land verpflichtet ist, dem Kläger Grundvergütung nach der Vergütungsgruppe V b der Anlage 1a zum BAT nach der höchsten Lebensaltersstufe dieser Vergütungsgruppe für die Zeit vom 1. Mai 2008 bis zum 31. Dezember 2009 zu zahlen, als unzulässig verworfen.

  3. Der Kläger hat die Kosten der Berufung und der Revision zu tragen.
