In a revision proceeding in an employment dispute, the Federal Labor Court partially set aside the Hessian Regional Labor Court judgment. It held that the claimant's appeal was inadmissible insofar as it sought a declaration that the defendant state had to pay basic salary under pay group II a of the BAT at the highest age step for the period from 1 August 2008 to 31 December 2009. The court also ordered the claimant to bear the costs of the appeal and revision. The parties had waived findings of fact and reasons because of a parallel lead case.

Where the parties waive statement of facts and reasons in view of a lead case, the court may decide without a full written justification. If only a separable part of the appellate relief lacks admissibility, the revision court may partially set aside the appellate judgment and reject that part of the appeal as inadmissible, while leaving the remainder untouched. Costs follow the outcome of the unsuccessful appeal and revision.

Tenor

  1. Auf die Revision des beklagten Landes wird das Urteil des Hessischen Landesarbeitsgerichts vom 6. Januar 2010 - 2 Sa 1300/09 - teilweise aufgehoben.

  2. Die Berufung der Klägerin gegen das Urteil des Arbeitsgerichts Gießen vom 16. April 2009 - 1 Ca 193/09 - wird im Umfang der Feststellung, dass das beklagte Land verpflichtet ist, der Klägerin Grundvergütung nach der Vergütungsgruppe II a der Anlage 1a zum BAT nach der höchsten Lebensaltersstufe dieser Vergütungsgruppe für die Zeit vom 1. August 2008 bis zum 31. Dezember 2009 zu zahlen, als unzulässig verworfen.

  3. Die Klägerin hat die Kosten der Berufung und der Revision zu tragen.
