Resumo Omnilex

The Federal Court of Justice rejected the plaintiffs’ non-admission complaint against the Karlsruhe Higher Regional Court’s decision. It held that the matter lacked fundamental importance and that neither development of the law nor uniformity of case law required review. On the merits, the court reiterated that in a sham installment financing arrangement no consumer withdrawal right exists under §§ 495(1), 355 BGB when, after the fixed-interest period, only future loan terms are renegotiated in accordance with the original loan contract; the same applies to a forward loan if no new right to use capital is granted. The plaintiffs were ordered to bear the costs of the complaint proceedings.

Sumário Omnilex

§§ 495 Abs. 1, 355 BGB; sham installment financing and forward loan: no right of withdrawal where, after expiry of the fixed-interest period, only future conditions are newly agreed in execution of the original loan contract, or where the borrower is not granted a new capital-use right. Such a constellation does not constitute a new consumer loan transaction. The non-admission complaint is to be dismissed if the requirements of § 543(2) Satz 1 ZPO are not met; the revision court may dispense with detailed reasons under § 544(4) Satz 2 Halbs. 2 ZPO.

Whether the plaintiffs' non-admission complaint is admissible and justified.

Decisão extraída

The complaint was dismissed because the case had no fundamental importance and did not require a decision to develop the law or ensure uniform jurisprudence.

Fundamentação extraída

The Federal Court of Justice found no reason to admit the revision under § 543(2) ZPO and therefore declined to provide a full reasoning under § 544(4) ZPO.

Questão jurídica principal

Whether a consumer has a right of withdrawal under §§ 495(1), 355 BGB in a sham installment financing where only future loan conditions are reset after the interest-fixation period or in a forward loan without a new right to use capital.

Decisão extraída

No withdrawal right exists in that constellation.

Fundamentação extraída

Where, after expiry of the fixed-interest period, the bank and borrower merely agree on new future terms and implement the adjustment contemplated by the original loan agreement, no new consumer loan contract is created; the same applies to an advance-agreed redefinition of interest and repayment shares if no new capital-use right is granted.
