Resumo Omnilex

The Federal Court dismissed the defendants' revisions against the LG Erfurt judgment. It held that, despite an untidy structure in the reasons, the judgment still allowed the convicted acts to be identified from the reasons as a whole, and § 267(1) StPO does not require a complete record of all evidence. The revision of defendant W. was dismissed with the correction that the total imprisonment is four years. The defendants were ordered to bear the costs of their remedies.

Sumário Omnilex

§ 267 Abs. 1 StPO; requirements for criminal judgment reasons and reproduction of evidence: The reasons of a conviction must make it possible to assign the established facts to the objective and subjective elements of the offenses adjudicated. However, the court need not present every detail of the background or document all evidence taken; it suffices to state the essential evidentiary results and their assessment. Unclear structuring or the mixing of background facts, offense description, and evidence does not per se constitute reversible error if the reasons, read as a whole, still permit review of the conviction (consid. 2).

Meyer-Goßner/Appl, Die Urteile in Strafsachen, 29. Aufl., Rn. 281 ff.).

Whether the defendants' revisions against the LG Erfurt judgment were well founded.

Decisão extraída

The revisions disclosed no legal error to the defendants' detriment; the judgment was upheld, with a clerical correction for defendant W. as to the total prison term.

Fundamentação extraída

Although the reasons were confusing in parts, the overall context still allowed identification of the acts convicted and the relevant evidence. The requirements of § 267(1) StPO do not oblige the court to reproduce every detail or all evidence, but only the essential evidentiary results and their evaluation.

Questão jurídica principal

Whether the wording concerning defendant W.'s total sentence required correction.

Decisão extraída

The revision was dismissed subject to the correction that W. was sentenced to a total term of imprisonment of four years.

Fundamentação extraída

The tenor contained an obvious clerical mistake that had to be clarified, without affecting the rejection of the revision on the merits.

Questão jurídica principal

Who bears the costs of the unsuccessful revisions.

Decisão extraída

The defendants must bear the costs of their remedies.

Fundamentação extraída

Because the revisions were unsuccessful, the cost consequence follows.
