Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Stralsund vom 25. Februar 2015 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die dem Adhäsionskläger im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

  1. Entgegen der Ansicht des Generalbundesanwalts stand es dem Revisionsführer frei, die unterbliebene Vernehmung der Zeugin D. sowohl zum Gegenstand einer Beweisantragsrüge als auch zum Gegenstand einer Aufklärungsrüge zu machen. Die Entscheidung des Senats vom 13. Januar 2011 (3 StR 337/10, NStZ 2011, 471, 472) besagt lediglich, dass die Stoßrichtung der Rüge durch den Revisionsführer bestimmt wird (vgl. auch KK-Gericke, StPO, 7. Aufl., § 344 Rn. 34 mwN). Dies schließt nicht aus, dass er denselben Sachverhalt hinsichtlich mehrerer, nach den vorgetragenen Tatsachen in Betracht kommender Verfahrensmängel der Überprüfung durch das Revisionsgericht unterstellt.

Beide Rügen erweisen sich jedoch aus den vom Generalbundesanwalt dargelegten Gründen als jedenfalls unbegründet.

  1. Die Beanstandung, das Landgericht habe sich im Rahmen der Beweiswürdigung auf Angaben des Vaters des Angeklagten B. gestützt, obwohl dieser von seinem Zeugnisverweigerungsrecht nach § 52 Abs. 1 Nr. 3 StPO Gebrauch gemacht habe, greift nicht durch. Soweit die Strafkammer ausgeführt hat, dass auch die Zeugin Ba. die Angaben des Zeugen B. bestätigt habe, handelt es sich um ein offensichtliches Schreibversehen. Aus dem Kontext ergibt sich für jeden Leser ohne weiteres, dass die Zeugin Ba. - wie auch die Zeugen R. und M. - die Angaben des Zeugen W. bestätigt habe.
