The 5th Criminal Senate of the Federal Court of Justice answered a request from the 2nd Criminal Senate on whether an offender's personal and economic circumstances may be considered when fixing pain-and-suffering damages under § 253(2) BGB. The Senate disagreed with the requesting senate's view and relied on prior decisions of the Große Senat für Zivilsachen and the VI. Civil Senate. The decision resolves only the inter-senate legal question.

§ 253 Abs. 2 BGB; consideration of the tortfeasor's personal and economic circumstances when assessing pain-and-suffering damages: such circumstances are not decisive for the amount of compensation; the assessment is governed by the nature and extent of the injury and the compensatory function of the non-pecuniary damages, not by the defendant's financial capacity. § 406 Abs. 1 StPO does not alter this civil-law standard. The Senate follows the established jurisprudence of the civil senates and declines the contrary view (consid. 1).
