Tenor

Nachdem die Parteien den Rechtsstreit übereinstimmend für erledigt erklärt haben, trägt die Beklagte die Kosten des Rechtsstreits, weil sie die vom Kläger geltend gemachte Kostentragungspflicht anerkannt hat (§ 91a Abs. 1 Satz 1 ZPO, arg. § 307 ZPO; vgl. BGH, Beschluss vom 3. Juni 1985 - II ZR 248/84, juris Rn. 5).

Der Streitwert für das Revisionsverfahren wird auf 1.200 € festgesetzt. Eine zeitlich gestaffelte Festsetzung des Streitwerts ist nicht veranlasst. Der Streitwert bestimmt sich zwar im Anschluss an die Erledigungserklärungen der Parteien nur noch nach dem Kosteninteresse, soweit der Betrag den Wert der Hauptsache nicht übersteigt (Kurpat in Schneider/Herget, Streitwertkommentar, 13. Aufl., Rn. 2177 mwN). Allerdings ist weder ersichtlich noch dargelegt (§ 33 Abs. 1 RVG), dass für die Berechnung der Rechtsanwaltsgebühren ein anderer Wert als der für die Gerichtskosten maßgebliche ursprüngliche Hauptsachestreitwert von 1.200 € (vgl. § 40 GKG) von Bedeutung sein sollte. Zudem liegt das Kosteninteresse des Klägers über dem Wert der Hauptsache, so dass mit der Erledigung des Rechtsstreits unabhängig vom Zeitpunkt der Erledigungserklärung des Klägers keine Streitwertermäßigung verbunden sein kann (siehe zum Ganzen auch Jaspersen/Wache in BeckOK ZPO, Edition 14, § 91a Rn. 37).
