The Federal Court of Justice dismissed the claimant's complaint against the refusal to admit revision by the Higher Regional Court of Hamm in a civil case concerning alleged accident manipulation. It held that the complaint failed to show any ground for revision under Section 543(2) ZPO. The court also reiterated that, where accident manipulation is suspected, a liability insurer may deny both the occurrence of the accident and the alleged course of events with lack of knowledge, even if it acts not only for itself but also as intervenor for its insured. The claimant was ordered to bear the costs of the complaint proceedings.
§ 543 Abs. 2 S. 1 ZPO; complaint against refusal of leave to appeal; liability insurer in suspected staged-accident litigation may plead lack of knowledge as to both the occurrence and the alleged course of the accident, even when participating additionally as intervenor for the insured. The complaint is inadmissible as a vehicle for reopening the merits and must show, in a substantiated manner, a ground for revision. The insurer’s dual procedural role does not alter the burden or the admissibility of its denial of knowledge in such cases (cf. consid. 1).

Die Beschwerde des Klägers gegen die Nichtzulassung der Revision in dem Urteil des 6. Zivilsenats des Oberlandesgerichts Hamm vom 12. August 2013 wird zurückgewiesen, weil sie nicht aufzeigt, dass die Rechtssache grundsätzliche Bedeutung hat oder die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts erfordert (§ 543 Abs. 2 S. 1 ZPO). Bei dem Verdacht einer Unfallmanipulation darf der Haftpflichtversicherer sowohl den behaupteten Unfall als auch den behaupteten Unfallhergang mit Nichtwissen bestreiten, und zwar auch dann, wenn er in dem Rechtsstreit nicht nur für sich selbst, sondern zugleich auch als Streithelfer seines Versicherungsnehmers auftritt (vgl. Senatsbeschluss vom 29. November 2011 - VI ZR 201/10, VersR 2012, 434 Rn. 5).
Von einer weiteren Begründung wird gemäß § 544 Abs. 4 S. 2, 2. Halbs. ZPO abgesehen.
Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
