The defendant withdrew its revision against the judgment of the Frankfurt Higher Regional Court, as corrected. The Federal Court of Justice therefore declared the revision remedy forfeited and imposed the costs of the revision on the defendant. The decision is limited to the procedural consequence of withdrawal and the related cost allocation.
§§ 565, 516 Abs. 3 ZPO; withdrawal of a revision and cost consequences: If the appellant withdraws the revision, the Federal Court of Justice declares the remedy forfeited. The withdrawal ends the appellate proceedings without review of the merits; the costs of the revision are to be borne by the withdrawing party. The dispositive order is procedural in nature and does not decide the substantive dispute (consid. 1).
