Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Amberg vom 23. Oktober 2012 wird als unbegründet verworfen, da die Nachprüfung des Urteils keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die der Nebenklägerin im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

Das Landgericht hat den Angeklagten zu Recht wegen schweren sexuellen Missbrauchs einer widerstandsunfähigen Person gemäß § 179 Abs. 1 Nr. 1, Abs. 5 Nr. 1 StGB verurteilt. Nach den rechtsfehlerfrei getroffenen Feststellungen führte der Angeklagte der Geschädigten, während diese fest schlief, zunächst zwei Finger in die Vagina ein. Anschließend drang er mit seinem Penis in ihr Geschlechtsteil ein und vollzog für kurze Zeit den vaginalen Geschlechtsverkehr an ihr. Die Geschädigte hat von beiden Vorgängen wegen ihres Schlafs nichts bemerkt. Erst nachdem die Lebensgefährtin des Angeklagten diesen bei der Tatausführung überrascht und er den weiteren Geschlechtsverkehr darauf abgebrochen hatte, wurde die Geschädigte geweckt und über das Geschehene informiert.

Damit hat der Angeklagte eine aufgrund einer "tiefgreifenden Bewusstseinsstörung" zum Widerstand unfähige Person im Sinne von § 179 Abs. 1 Nr. 1 StGB missbraucht. In der Rechtsprechung des Bundesgerichtshofs ist anerkannt, dass es sich bei dem Schlaf um eine tiefgreifende Bewusstseinsstörung im Sinne der genannten Vorschrift handelt (BGH, Urteil vom 24. September 1991 - 5 StR 364/91, BGHSt 38, 68, 71; ebenso bereits BGH, Beschluss vom 3. Juni 1982 - 4 StR 271/82, JR 1983, 210 f.; zustimmend etwa Molketin NStZ 1992, 179 f.; Renzikowski in: Münchener Kommentar zum StGB, 2. Aufl., § 179 Rn. 25). Daran hält der Senat fest.

Dieser Rechtsprechung steht das Urteil des 2. Strafsenats des Bundesgerichtshofs vom 28. Januar 2004 (2 StR 351/03, NStZ 2004, 440, 441) nicht entgegen. Der 2. Strafsenat hat sich dort hinsichtlich eines Opfers sexueller Handlungen, das "im Begriff war, einzuschlafen" bzw. "im Halbschlaf" war, mit dem Eingreifen von § 179 Abs. 1 Nr. 1 StGB nicht befasst. Ob bei solchen Zuständen des Opfers von einer "tiefgreifenden Bewusstseinsstörung" ausgegangen werden könnte, bedarf keiner Entscheidung. Jedenfalls bei Tatbegehung während eines Schlafzustandes wie dem hier vom Landgericht festgestellten handelt es sich um eine solche Bewusstseinsstörung.
