The Federal Court of Justice dismissed the plaintiff's complaint against denial of leave to appeal from the OLG Hamm judgment concerning the review of church employment contract rules. It held that the matter raised no issue of fundamental significance and that neither development of the law nor the need for uniform case law justified review by the court of appeal. The relevant questions had already been clarified by Federal Labour Court case law, which the court expressly adopted. The complaint was therefore rejected at the complainant's expense.

Tenor

Die Beschwerde gegen die Nichtzulassung der Revision in dem Urteil des 20. Zivilsenats des Oberlandesgerichts Hamm vom 25. Februar 2011 wird auf Kosten des Klägers zurückgewiesen, weil weder die Rechtssache grundsätzliche Bedeutung hat noch die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts erfordert (§§ 543 Abs. 2, 544 Abs. 4 Satz 2 ZPO).

Die von der Nichtzulassungsbeschwerde aufgeworfenen Rechtsfragen sind durch die Rechtsprechung des Bundesarbeitsgerichts, der sich der Senat anschließt, hinreichend geklärt (vgl. BAG, Urteile vom 6. November 1996 - 5 AZR 334/95, BAGE 84, 282 ff.; vom 19. August 2008 - 3 AZR 383/06, NZA 2009, 1275 ff.; vom 22. Juli 2010 - 6 AZR 847/07, BAGE 135, 163 ff.)
