The Federal Court of Justice dismissed the defendant’s revision against the judgment of the Landgericht Braunschweig. It held that the Generalbundesanwalt could still validly affirm the special public interest in prosecuting the simple bodily injury counts in the appellate instance. This was possible because the trial court had previously indicated under Section 265 StPO that conviction for simple bodily injury was also conceivable, and the procedural participants had not objected, so no implied contrary position of the prosecution arose. The defendant was ordered to bear the costs of the appeal and the necessary expenses of the private accessory prosecutor.
§§ 223 Abs. 1, 230 Abs. 1 StGB; § 265 StPO; special public interest in prosecution of bodily injury may be affirmed for the first time in revision. If the trial court has indicated pursuant to § 265 StPO that conviction for simple bodily injury is also possible, and the parties remain silent, no implied negative decision on the public interest in prosecution can be inferred. The Generalbundesanwalt is then not barred from affirming the required public interest in the appellate stage; a prosecution condition may thus still be cured or completed in revision (cf. consid. on the absence of a contrary procedural declaration).

Bejahung des besonderen öffentlichen Interesses an der Verfolgung einer Körperverletzung im Revisionsverfahren
Die Revision des Angeklagten gegen das Urteil des Landgerichts Braunschweig vom 22. Februar 2011 wird nach § 349 Abs. 2 StPO als unbegründet verworfen.
Der Beschwerdeführer hat die Kosten des Rechtsmittels und die dadurch der Nebenklägerin entstandenen notwendigen Auslagen zu tragen.
Der Generalbundesanwalt konnte das besondere öffentliche Interesse an der Strafverfolgung hinsichtlich der in den Urteilsgründen Ziffer II.4 und II.5 abgeurteilten Fälle der Körperverletzung gemäß §§ 223 Abs. 1, 230 Abs. 1 StGB in der Revisionsinstanz noch wirksam bejahen. Das Landgericht hat in der Hauptverhandlung vom 4. Januar 2011 gemäß § 265 StPO darauf hingewiesen, dass wegen der angeklagten Fälle der gefährlichen Körperverletzung jeweils auch eine Verurteilung wegen einfacher Körperverletzung in Betracht komme. Ausweislich des Sitzungsprotokolls haben die Verfahrensbeteiligten hierzu keine Stellungnahme abgegeben, so dass eine konkludente Verneinung des öffentlichen Interesses an der Strafverfolgung durch die Staatsanwaltschaft, an die der Generalbundesanwalt gebunden wäre, nicht vorliegt (vgl. BGH, Urteil vom 3. Juli 1964 - 2 StR 208/64, BGHSt 19, 377, 381; Urteil vom 15. Januar 1975 - 3 StR 312/74, bei Dallinger MDR 1975, 367).
