The BGH rejected the defendant's revision against a Berlin conviction. Out-of-court recognition evidence only requires discussion of concrete, outcome-relevant error sources; absent such indicators, no further reasoning is necessary (consid. 2).

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Berlin vom 28. Januar 2011 wird nach § 349 Abs. 2 StPO als unbegründet verworfen.

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die dadurch der Adhäsions- und Nebenklägerin J. entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

  1. Selbst wenn davon auszugehen wäre, dass es sich bei den gemäß § 267 Abs. 1 Satz 3 StPO in Bezug genommenen, auf CD gespeicherten Videofilmen (zwei CD „Überwachung“ und eine CD „sequenzielle Videowahlgegen-überstellung“) um Abbildungen im Sinne dieser Vorschrift handeln würde (vgl. OLG Dresden, NZV 2009, 520 mwN; aA Meyer-Goßner, StPO, 54. Aufl., § 267 Rn. 9 f.; OLG Brandenburg, DAR 2005, 635, 636), läge hier eine wirksame Inbezugnahme nicht vor.

Hinsichtlich der Videowahlgegenüberstellung wird schon die Fundstelle in der Akte nicht angegeben. Bezüglich des Überwachungsvideos ist der Umfang der – hier auf den gesamten Inhalt der beiden Datenträger bezogenen – Verweisung nicht so ausreichend bestimmt, um daraus den auf dem Überwachungsvideo erkennbaren Täter zu identifizieren. Die gebotene Klarheit des Inhalts der Urteilsgründe wird bei einer solchen Fassung verfehlt (vgl. OLG Brandenburg aaO).

Es kann zudem nicht Aufgabe des Revisionsgerichts sein, anhand der Beschreibungen des Tatverdächtigen im Urteil die Körpermerkmale des auf dem Videofilm in Bezug genommenen Mannes nach wertender Betrachtung selbst an parater Stelle des Films aufzufinden. Hierbei handelte es sich nicht mehr um eine Nachvollziehung des Urteils, sondern um einen Akt der Beweiswürdigung, der dem Revisionsgericht gemäß § 337 Abs. 1 StPO versagt ist.

Indes enthalten bereits die Gründe des angefochtenen Urteils auch ohne die Verweisungen eine aus sich heraus verständliche, allein tragfähige Identifizierung des Angeklagten als Täter, die auf möglichen und nachvollziehbaren Schlussfolgerungen beruht (vgl. BGH, Urteil vom 4. November 1988 – 1 StR 262/88 – BGHSt 36, 1, 14).

  1. Aus einem von der ersten Geschädigten bekundeten Wiedererkennen des Angeklagten außerhalb des Verfahrens ergaben sich jedenfalls keine im Urteil unerlässlich erörterungsbedürftigen potentiellen Fehlerquellen für das Beweiswürdigungsergebnis.
