Resumo Omnilex

The Federal Court of Justice rejected the defendant's hearing complaint as inadmissible. The complaint did not sufficiently demonstrate a decisive violation of the right to be heard because the earlier judgment had already independently upheld the claims on the basis of the product's pharmacological effect. In any event, the challenged reasoning also adequately explained why the findings supported a metabolic effect. Costs were imposed on the defendant.

Sumário Omnilex

Art. 321a Abs. 1 Satz 1 Nr. 1, Abs. 2 Satz 1 and 5 ZPO; substantiation requirements for a hearing complaint: the complainant must specifically allege a decisive violation of the right to be heard and show its potential relevance to the outcome. A complaint is inadmissible where it fails to engage with an independently supporting ground of the prior decision, since then any alleged omission in the challenged passage cannot be decisive (consid. 1). The complaint is also unfounded if the court had in fact addressed the allegedly ignored issue sufficiently and in detail (consid. 2).

Anhörungsrüge: Anforderungen an die Darlegung der Gehörsverletzung

Tenor
