Die Beschwerde des Klägers gegen die Nichtzulassung der Revision in dem Urteil des 12. Zivilsenats des Oberlandesgerichts Hamm vom 25. März 2009 wird zurückgewiesen.

Die Erwägungen des Berufungsgerichts sind rechtsfehlerhaft, sofern es meint, die Verjährung des Schadenersatzanspruchs nach § 635 BGB a.F. könne schon vor der Abnahme beginnen und sie richte sich nach den Vorschriften über die Regelverjährung statt nach § 634a BGB n.F. Beide Punkte hat der Senat nach Erlass des Berufungsurteils, teils in Abkehr von seiner früheren Rechtsprechung, geklärt (BGH, Urteil vom 8. Juli 2010 - VII ZR 171/08, BauR 2010, 1778 = NZBau 2010, 768, und Urteil vom 24. Februar 2011 - VII ZR 61/10, NJW 2011, 1224). Hierauf wird verwiesen. Das ist jedoch nicht entscheidungserheblich. Das Berufungsurteil wird von den weiteren Erwägungen zur Verwirkung getragen. Von einer Begründung wird insoweit abgesehen, weil sie nicht geeignet wäre, zur Klärung der Voraussetzungen beizutragen, unter denen eine Revision zuzulassen ist (§ 544 Abs. 4 Satz 2, 2. Halbsatz ZPO).

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
