Tenor

Die Erinnerung des Verurteilten gegen den Kostensansatz vom 15. Januar 2010 wird als unbegründet zurückgewiesen.

Das Verfahren über die Erinnerung ist gebührenfrei. Kosten werden nicht erstattet.

Gründe

1 Der Antrag des Verurteilten ist als Erinnerung zu werten, soweit er sich gegen den Kostenansatz richtet. Der Rechtsbehelf ist nach § 66 Abs. 1 GKG zulässig, jedoch unbegründet. Die Kostenbeamtin beim Bundesgerichtshof hat - was der Verurteilte hinsichtlich der rechnerischen Richtigkeit auch nicht in Abrede stellt - nach § 19 Abs. 2 Satz 4 i.V.m. § 3 Abs. 2 GKG zu Recht eine Gebühr in Höhe von 1.260 € für das Revisionsverfahren angesetzt. Mangels offenkundigen oder der Kostenbeamtin sonst bekannten Zahlungsunvermögens des Verurteilten widerstreitet der Kostenansatz auch nicht der - die Gerichte ohnehin nicht bindenden - Verwaltungsvorschrift des § 10 Abs. 1 KostVfg.

2 Aus dem Kostenansatz muss dem Verurteilten kein Nachteil entstehen, namentlich auch nicht unter dem Aspekt des Resozialisierungsgebots. Denn seinen Interessen kann im Beitreibungsverfahren sachgerecht Rechnung getragen werden (vgl. BVerfG [Kammer], Beschluss vom 27. Juni 2006 - 2 BvR 1392/02), hinsichtlich dessen der Verurteilte ohnehin Anträge gestellt hat. Für Maßnahmen im Zuge des Beitreibungsverfahrens besteht keine Zuständigkeit des Senats.

3 Der Senat entscheidet gemäß § 139 Abs. 1 GVG in der Besetzung von fünf Mitgliedern einschließlich des Vorsitzenden (vgl. BGH, Beschluss vom 5. April 2006 - 5 StR 569/06 mwN).
