The Federal Court of Justice refused the applicant legal aid for a complaint against the Higher Regional Court’s refusal to admit revision in a tax adviser liability dispute. The court held that the intended complaint had no sufficient prospect of success. Der Antrag auf Gewährung von Prozesskostenhilfe für die Einlegung und Durchführung einer Beschwerde gegen die Nichtzulassung der Revision in dem Urteil des 23. Zivilsenats des Oberlandesgerichts Düsseldorf vom 9. März 2010 wird abgelehnt.

Gründe

1 Die von dem Antragsteller beabsichtigte Beschwerde hat keine hinreichende Aussicht auf Erfolg (§ 114 ZPO).

2 Die Rechtssache hat keine grundsätzliche Bedeutung, und weder die Fortbildung des Rechts noch die Sicherung einer einheitlichen Rechtsprechung erfordert eine Entscheidung des Revisionsgerichts (§ 543 Abs. 2 ZPO).

3 Entgegen der Ansicht des Antragstellers weist die Sache keine Grundsatzbedeutung auf. Die Frage, ob ein Steuerberater verpflichtet ist, seinem Mandanten die Hinzuziehung eines Anwalts zu empfehlen, lässt sich nicht allgemein gültig beantworten, sondern ist von den Umständen des jeweiligen Einzelfalles abhängig (vgl. BGH, Urt. v. 12. Februar 2004 - IX ZR 242/02, WM 2004, 2034, 2036). Die geltend gemachte Divergenz zu den Entscheidungen OLG Karlsruhe ZIP 2007, 2319 (aufgehoben durch BGH, Urt. v. 10. Dezember 2009 - IX ZR 238/07, HFR 2010, 661) und OLG Köln VersR 2006, 87 besteht aus den vom Berufungsgericht dargelegten Gründen nicht. Ein entscheidungserheblicher Gehörsverstoß ist nicht ersichtlich.
