§ 46 Abs. 3 StGB; drug trafficking under § 29a BtMG already presupposes a profit-oriented or otherwise personally advantageous motive, so this element may not again be used to the defendant’s detriment in sentencing. Nor may the court aggravate punishment by referring to the offender’s failure to desist from the offense or by treating the absence of possible mitigating factors, such as addiction or financial distress, as an adverse circumstance. If it cannot be excluded that the sentencing error affected the individual penalties and the total sentence, the sentence and the related findings must be quashed and the matter remitted for a fresh sentencing decision (consid. 4–5).

Tenor

  1. Auf die Revision des Angeklagten wird das Urteil des Landgerichts Schwerin vom 21. Mai 2010 im Strafausspruch mit den zugehörigen Feststellungen aufgehoben.

  2. Im Umfang der Aufhebung wird die Sache zu neuer Verhandlung und Entscheidung, auch über die Kosten des Rechtsmittels, an eine andere Strafkammer des Landgerichts zurückverwiesen.

  3. Die weiter gehende Revision wird verworfen.

Gründe

1 Das Landgericht hat den Angeklagten wegen unerlaubten Handeltreibens mit Betäubungsmitteln in nicht geringer Menge in zehn Fällen zu einer Gesamtfreiheitsstrafe von fünf Jahren und sechs Monaten verurteilt; außerdem hat es Verfalls- und Einziehungsanordnungen getroffen. Mit seiner hiergegen eingelegten Revision rügt der Angeklagte die Verletzung formellen und materiellen Rechts. Das Rechtsmittel hat zum Strafausspruch Erfolg; im Übrigen ist es unbegründet im Sinne des § 349 Abs. 2 StPO.

2 Der Strafausspruch hat keinen Bestand.

3 a) Das Landgericht hat neben anderen Zumessungserwägungen zu Lasten des Angeklagten gewertet, "dass ihm der Ausstieg aus den illegalen Geschäften jederzeit möglich war, denn er war weder in finanzieller Not noch selbst drogenabhängig. Ein daraus abzuleitendes Motiv ist nicht ersichtlich. Er wollte mit den Geschäften Gewinne erzielen bzw. eigene Aufwendungen ersparen" (UA 21).

4 b) Diese Erwägungen begegnen durchgreifenden rechtlichen Bedenken. Mit der Gewinnerzielungsabsicht hat das Landgericht zu Lasten des Angeklagten einen Umstand in die Strafzumessung eingestellt, dessen Berücksichtigung gegen das Doppelverwertungsverbot des § 46 Abs. 3 StGB verstößt, denn das Handeltreiben im Sinne des § 29a Abs. 1 Nr. 2 BtMG setzt stets voraus, dass der Täter nach Gewinn strebt oder sich irgendeinen anderen persönlichen Vorteil verspricht (vgl. BGH - Großer Senat -, Beschluss vom 26. Oktober 2005 - GSSt 1/05 -, BGHSt 50, 252, 256; BGH, Beschlüsse vom 23. November 1988 - 3 StR 503/88, BGHR BtMG § 29 Abs. 1 Nr. 1 Handeltreiben 15 m.w.N., und vom 24. September 2009 - 3 StR 294/09, NStZ-RR 2010, 24, 25). Auch die strafschärfende Erwägung, dass der Angeklagte von der Möglichkeit, von der Begehung der Taten Abstand zu nehmen, keinen Gebrauch gemacht hat, stellt einen Verstoß gegen das Doppelverwertungsverbot dar (vgl. BGH, Beschluss vom 15. Oktober 2003 - 2 StR 332/03 m.w.N.). Schließlich begegnet es auch rechtlichen Bedenken, dass das Landgericht das Fehlen möglicher Strafmilderungsgründe (Suchtmittelabhängigkeit, finanzielle Notlage) zu Lasten des Angeklagten berücksichtigt hat (vgl. Stree/Kinzig in Schönke/Schröder StGB 28. Aufl. § 46 Rn. 57d m.w.N.).

5 c) Der Senat vermag nicht sicher auszuschließen, dass das Landgericht ohne die fehlsamen Erwägungen auf niedrigere Einzelstrafen und eine noch mildere Gesamtstrafe erkannt hätte, und hebt daher - entsprechend dem Antrag des Generalbundesanwalts - den gesamten Strafausspruch mit den zugehörigen Feststellungen auf.
