Tenor

Die Beschwerde des Klägers gegen die Nichtzulassung der Revision in dem Urteil des 1. Zivilsenats des Oberlandesgerichts Naumburg vom 12. Januar 2010 wird zurückgewiesen, weil sie nicht aufzeigt, dass die Rechtssache grundsätzliche Bedeutung hat oder die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts erfordert (§ 543 Abs. 2 S. 1 ZPO). Die stationäre Zwangsbehandlung aufgrund eines landesrechtlichen Unterbringungsgesetzes erfolgt auch dann hoheitlich, wenn sie in der geschlossenen Abteilung einer städtischen Klinik erfolgt (vgl. OLG Oldenburg AHRS 0835/107 mit NA-Beschluss des BGH vom 23. Februar 1995 – III ZR 205/94 – NJW 1995, 2412 = AHRS 0465/103, § 839 Abs. 1 Satz 2 BGB, Art. 34 GG).

Von einer weiteren Begründung wird gemäß § 544 Abs. 4 S. 2, 2. Halbs. ZPO abgesehen.

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
