Die Beschwerde der Klägerin gegen die Nichtzulassung der Revision in dem Urteil des 18. Zivilsenats des Oberlandesgerichts München vom 12. Mai 2009 wird zurückgewiesen, weil keiner der im Gesetz (§ 543 Abs. 2 ZPO) vorgesehenen Gründe vorliegt, nach denen der Senat die Revision zulassen darf. Der Rechtsstreit der Parteien hat weder grundsätzliche Bedeutung, noch erfordert er eine Entscheidung des Revisionsgerichts zur Fortbildung des Rechts oder zur Sicherung einer einheitlichen Rechtsprechung. Es spricht viel für die Annahme des Berufungsgerichts, dass die Versorgungsregelung in der von der Klägerin befürworteten Auslegung eine unzulässige Kündigungsbeschränkung i.S.v. § 723 Abs. 3 BGB darstellt.

Von einer näheren Begründung wird gemäß § 544 Abs. 4 Satz 2, 2. Halbsatz ZPO abgesehen.

Die Klägerin trägt die Kosten des Beschwerdeverfahrens (§ 97 ZPO).
