The Federal Court of Justice rejected the defendants’ complaint against the Higher Regional Court of Munich’s denial of leave to appeal. It found that none of the statutory grounds for admitting revision under § 543 Abs. 2 ZPO were present, in particular no fundamental question and no need to secure uniform case law. Tenor

Die Beschwerde der Beklagten gegen die Nichtzulassung der Revision in dem Urteil des 7. Zivilsenats des Oberlandesgerichts München vom 15. Oktober 2008 wird zurückgewiesen, weil keiner der im Gesetz (§ 543 Abs. 2 ZPO) vorgesehenen Gründe vorliegt, nach denen der Senat die Revision zulassen darf. Der Rechtsstreit der Parteien hat weder grundsätzliche Bedeutung, noch erfordert er eine Entscheidung des Revisionsgerichts zur Fortbildung des Rechts oder zur Sicherung einer einheitlichen Rechtsprechung. Der Senat hat die Verfahrensrügen geprüft und für nicht durchgreifend erachtet.

Von einer näheren Begründung wird gemäß § 544 Abs. 4 Satz 2, 2. Halbsatz ZPO abgesehen.

Die Beklagten tragen die Kosten des Beschwerdeverfahrens (§ 97 ZPO).
