The Federal Court of Justice allowed the defendant’s revision against the total sentence. It held that the total sentence, even after being reduced by one year, still suffered from the same defect identified in the Senate’s earlier decision: the significant increase over the starting sentence was not adequately reasoned. The sentencing part of the Regional Court of Bautzen’s judgment of 29 September 2009 was therefore set aside. The case was remitted to the Regional Court of Dresden for a new decision on the total sentence and on the costs of the revision.

A total sentence that departs markedly from the single or base sentence must be supported by concrete sentencing reasons showing why the combined penalty corresponds to guilt and the overall criminality. If the sentencing court fails to provide sufficient reasons for the extent of the increase, the total sentence cannot stand. A merely reduced increase does not cure the defect where the underlying justification remains inadequate (cf. consid. in the sense of the earlier Senate decision).

Tenor

Auf die Revision des Angeklagten wird das Urteil des Landgerichts Bautzen vom 29. September 2009 nach § 349 Abs. 4 StPO aufgehoben. Die Gesamtstrafe unterliegt ungeachtet der Reduzierung um ein Jahr denselben Bedenken, die dem Senatsbeschluss vom 5. August 2009 in dieser Sache zugrunde liegen.

Zu neuer Verhandlung und Entscheidung über den Gesamtstrafausspruch - sowie über die Kosten der Revision - wird die Sache nunmehr an das Landgericht Dresden zurückverwiesen.
