In this asylum-related revision case, the parties jointly declared the dispute settled after the respondent later granted the claimant protection. The Federal Administrative Court therefore discontinued the proceedings. It also declared the judgments of the Hessian Administrative Court of Appeal and the Administrative Court Wiesbaden ineffective insofar as they had ordered a deportation ban under § 60(7) sentence 1 AufenthG in conjunction with the Qualification Directive. The court allocated the costs by equity: the respondent had to bear the costs of the revision and second-instance proceedings, while first-instance costs were shared equally. If the respondent subsequently grants the protection sought, it may be treated as having voluntarily assumed the role of the losing party for costs purposes. Where a lower-court judgment has become ineffective only in relation to the exhausted subject matter, the court may so declare to that extent. Court costs remain excluded in asylum matters under § 83b AsylVfG; the amount in dispute follows § 30 RVG.

Tenor

Das Verfahren wird eingestellt.

Das Urteil des Hessischen Verwaltungsgerichtshofs vom 28. Januar 2009 und das Urteil des Verwaltungsgerichts Wiesbaden vom 22. Mai 2007 sind unwirksam, soweit sie die Feststellung eines Abschiebungsverbots nach § 60 Abs. 7 Satz 1 AufenthG i.V.m. Art. 15 Buchst. b und Art. 18 der Richtlinie 2004/83/EG betreffen.

Die Beklagte trägt die Kosten des Revisionsverfahrens und des Verfahrens zweiter Instanz, soweit sie nicht bereits von der Kostenentscheidung im Beschluss des Hessischen Verwaltungsgerichtshofs vom 6. September 2007 (6 UZ 1631/07.A) erfasst sind. Die Kosten des Verfahrens erster Instanz tragen der Kläger und die Beklagte je zur Hälfte.

Gründe

1 Die Beteiligten haben den Rechtsstreit, soweit er noch nicht rechtskräftig abgeschlossen war, übereinstimmend in der Hauptsache für erledigt erklärt. Das Verfahren ist deshalb in entsprechender Anwendung des § 92 Abs. 3 VwGO in Verbindung mit den §§ 141,125 Abs. 1 VwGO einzustellen, die teilweise Unwirksamkeit der Entscheidungen der Vorinstanzen festzustellen und hinsichtlich des noch anhängig gewesenen Verfahrens gemäß § 161 Abs. 2 VwGO über die Kosten des Verfahrens nach billigem Ermessen unter Berücksichtigung des bisherigen Sach- und Streitstands zu entscheiden.

2 Billigem Ermessen entspricht es hier, die Kosten insoweit der Beklagten aufzuerlegen. Das Berufungsgericht ist davon ausgegangen, dass der Kläger sowohl die Voraussetzungen des § 60 Abs. 7 Satz 1 AufenthG als auch die Voraussetzungen des Art. 15 Buchst. b i.V.m. Art. 18 der Richtlinie 2004/83/EG (Qualifikationsrichtlinie) erfüllt. Soweit es die Beklagte zur Feststellung eines Abschiebungsverbots nach „§ 60 Abs. 7 Satz 1 AufenthG i.V.m. Art. 15 Buchst. b und Art. 18 der Richtlinie 2004/83/EG“ verpflichtet hat, hat es allerdings nicht berücksichtigt, dass es sich bei § 60 Abs. 7 Satz 1 AufenthG um ein rein nationales Abschiebungsverbot handelt, während bei Vorliegen der Voraussetzungen des Art. 15 Buchst. b der Richtlinie 2004/83/EG nach § 60 Abs. 2 AufenthG ein eigenständiges - vorrangig vor sonstigen herkunftslandbezogenen nationalen Abschiebungsverboten zu prüfendes - Abschiebungsverbot besteht (vgl. Senatsurteil vom 24. Juni 2008 - BVerwG 10 C 43.07 - BVerwGE 131, 198 <201 ff.>). Dies ändert aber nichts daran, dass das Verwaltungsgericht die Beklagte der Sache nach zur Feststellung eines Abschiebungsverbots in Umsetzung des subsidiären Schutzkonzepts der Qualifikationsrichtlinie verpflichtet hat. Dem ist die Beklagte mit der zwischenzeitlichen Feststellung eines Abschiebungsverbots nach § 60 Abs. 2 AufenthG nachgekommen. Damit hat sie den Kläger klaglos gestellt und sich aus eigenem Entschluss in die Rolle der Unterlegenen begeben.

3 Gerichtskosten werden gemäß § 83b AsylVfG nicht erhoben. Der Gegenstandswert ergibt sich aus § 30 RVG.
