Resumo Omnilex

The Düsseldorf Local Court ordered the tenant to vacate and surrender the rented apartment and its keys by 30 August 2019. The landlord had terminated the tenancy without notice after the tenant published threats of physical violence and insults against him on a social network. The court held that the posts justified immediate termination; it construed “Huso” as an insult meaning “son of a whore” and “Hundesohn” as denying the recipient’s humanity. The tenant was also ordered to reimburse EUR 218.72 in termination costs, with interest from 10 April 2018, and to bear the litigation costs.

BGB §§ 543 Abs. 1, 546 Abs. 1; termination of a tenancy without notice for threats and insults made by a tenant against the landlord in a public social-network post. A tenant’s public threat of physical violence against the landlord may constitute an important reason justifying immediate termination. The same applies to a public insult where, assessed objectively from the recipient’s perspective, the conduct seriously violates the landlord’s personal rights. “Huso” is understood as “son of a whore” and is insulting. Calling the recipient “Hundesohn” denies his descent from a human being and thereby attacks human dignity; the expression is therefore insulting.
